Terms and Conditions

1. Scope These Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activities. An entrepreneur is a natural or legal person or a legally competent partnership that, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activities.

2. Contracting Party, Conclusion of Contract, and Correction Options The purchase contract is concluded with eFoil Riders. By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the order process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive confirmation via email.

3. Contract Language, Storage of Contract Text The language available for the conclusion of the contract is German. We store the contract text and send you the order details and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Conditions We deliver within Germany free of charge. You have the option of collecting the goods at eFoil Riders GmbH, Meintestraße 6, 37671 Höxter, Germany, during the following business hours: From 09:00-17:00. We do not deliver to parcel stations.

5. Payment The following payment methods are generally available in our shop:

  • Advance Payment: When selecting this payment method, we will provide our bank details in a separate email, and the goods will be delivered after receipt of payment.
  • PayPal: During the order process, you will be redirected to the PayPal website. To pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction, which is carried out automatically by PayPal immediately afterward. Further information is provided during the order process.
  • Paydirekt: After placing the order, you will be redirected to the Paydirekt website. To pay the invoice amount via Paydirekt, you must have an online banking account activated for Paydirekt, be registered there or first register, authenticate with your access data, and confirm the payment instruction to us. Immediately after the order, we request Paydirekt to initiate the payment transaction, which is carried out automatically by Paydirekt. Further information is provided during the order process.
  • Cash Payment on Collection: You pay the invoice amount in cash upon collection.

6. Retention of Title The goods remain our property until full payment has been received.

7. Transport Damage If goods are delivered with obvious transport damage, please report such defects to the delivery service as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us assert our claims against the carrier or transport insurance.

8. Warranty and Guarantees The statutory liability for defects applies. Information on any applicable additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.

9. Liability We are always liable without limitation for claims due to damages caused by us, our legal representatives, or vicarious agents:

  • for injury to life, body, or health,
  • for intentional or grossly negligent breaches of duty,
  • for guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

For the violation of essential contractual obligations, whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies (cardinal obligations), due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited to the foreseeable damage typical for the contract.

Otherwise, claims for damages are excluded.

10. Dispute Resolution The European Commission provides a platform for online dispute resolution (OS), which you can find here: [https://ec.europa.eu/consumers/odr/]. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
